Booking Terms and Conditions for Forest Side Hotel
These conditions of booking and information set out the terms on which you contract with Forest Side Hotel and Grasmere Lodge. They shall be governed by and construed in accordance with English Law, being subject to the jurisdiction of the Courts of England and Wales.

Your booking
You can book the accommodation and take up the offers shown in our literature if the accommodation is still available. You must be 18 years or over when you book your accommodation. Your booking is being made as a consumer and you acknowledge that no liability can be accepted for any business losses howsoever incurred by you. When your holiday confirmation is received, the details must be checked carefully. If anything is not correct you should tell us immediately.

Paying for your holiday.
When you book your holiday you should pay the amount then due by credit or debit card. We then send your written confirmation as soon as reasonably possible showing your holiday details and the balance of your holiday cost. However if you book less than 6 weeks before the start of your holiday, payment of your total holiday cost is due straight away. For holidays booked less than 2 weeks before holiday departure your holiday must be paid by credit card or debit card, or by bank transfer, at the time of booking.

Force majeure
We regret we cannot accept responsibility or pay any compensation where the performance or prompt performance of our contract with you is prevented or affected by reason of circumstances which amounts to 'force majeure'. Circumstances amounting to force majeure include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or loss of services to the property, (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, and explosion, storm or any other weather damage, break in, criminal damage, or any similar event. Such circumstances also include riots or civil strife, industrial action, natural or nuclear disaster, actual or threatened terrorist activity, war or threat of war. And all similar situations beyond our control.

Hotel & apartmentdescriptions
The hotel aims to ensure that the information provided are accurately conveyed in the brochure/web site or advertised by us. There may be slight differences between the actual room, apartment or menu and its description as the Hotel is always seeking to improve services and facilities. If problems occur which mean that the service or facilities become unavailable, we will tell you as soon as reasonably practical. Similarly, we cannot accept responsibility for any changes or closures to area amenities or attractions mentioned in the literature, by the hotel or advertised elsewhere.

Death, personal injury or loss of property
The company shall have no liability to you for the death or personal injury to you or any member of your party, or in the case of the hotel this results from the act or omission of the Hotel. You must take all necessary steps to safeguard your personal property and no liability to you is accepted in respect of damage to any loss of property.

Your vehicles
Your vehicles and any accessories and contents are left entirely at your own risk we will not be held responsible for any loss and damage from or to any vehicle from any cause whatsoever.

If you change your holiday
If you want us to change your holiday arrangements once we have issued your holiday confirmation, an administration fee of £25 will be payable to us once any change has been made. However it is important to realise that we may treat requests for changes of holiday dates as the cancellation of one holiday and the booking of another. In such cases cancellation charges may be incurred. We will advise you if this is the case and you must inform us within 48 hours whether you wish to continue with the original holiday or if you still wish to change your booking. If you advise us that you do not wish to continue with your original booking arrangements or fail to contact us within 48 hours we shall treat your original booking as being cancelled by you.

If you cancel your holiday
Telephone us immediately if you have to cancel your holiday. You must also confirm your cancellation in writing sent immediately to us by recorded delivery to the hotel address. The day we receive your notification of cancellation is the date on which your holiday arrangements are cancelled. A cancellation charge will be payable, based on the number of days from the cancellation date and the holiday start date as shown in the table below. This means that if you have paid the balance of the holiday cost and then have to cancel, you may receive a refund on part of the holiday cost. However, if you have not paid the total holiday cost by the time of your cancellation, you may be required to make a further payment to us. For the purpose of this table, holiday cost meant the total cost of the holiday including any extra items. If any payment in relation to the holiday is not paid by the appropriate date, we can treat your holiday as cancelled by you and charge you cancellation charges which can be as high as the total cost of the holiday. We normally send out a reminder to you before we cancel your holiday, although we may charge you £10 for each reminder we send. When you book your holiday you take on the responsibility for paying for the holiday in full, so to protect you against unforeseen circumstances causing you to cancel, cancellation protection is obligatory. We reserve the right to refuse or cancel bookings if you do not have cover or is our opinion, inadequate if we cancel your holiday for this reason then we will treat the cancellation as if you cancelled the holiday.

Your holiday accommodation
You can arrive at your accommodation after 3:00pm on the start of your holiday and you must leave by 11:00am on the last day. If you are delayed you should advise the manager at the hotel, so that alternative arrangements can be made. If you fail to arrive by midday on the day after the start date and you do not advise the manager of your late arrival, we may treat the booking as cancelled by you. You agree to keep the accommodation clean and tidy, and leave the property in a similar condition. You are responsible for the actual costs of any breakages or damage in or to the property - along with any additional costs that may result - which are caused by you or your party and we reserve the right to require you to pay such costs. We retain the right to refuse to hand over to you, or to repossess, accommodation if damage has been caused. You will treat these circumstances as a cancellation and Section 8 will apply. You cannot allow more people than the brochure/web pages states to stay in the accommodation, nor can you take your pet into the accommodation without prior written approval from the manager. There will be a corkage charge of £6 for each bottle of wine or spirits opened, but not bought from the hotel. The hotel reserves the right of access to the accommodation at any reasonable time during your holiday.

Group/Party Bookings
The organiser or leader of a group or party booking is responsible for completing the party details on the booking form and for informing the manager with any dietary requirements of the individuals within the group, at the time of booking.

Change or Rooms
The management reserves the right to offer you alternative rooms, or change rooms without notification, to meet with the demands of a busy hotel.

Animals
There are various animals within the curtilage of the hotel grounds, including deer, badgers, sheep dogs and cats. Pease note that these animals can bite and kick. All care and consideration should be given when approaching. All children should be closely supervised by an adult. Do not approach the animals from behind or when feeding. It is your responsibility to observe these considerations and we will not accept any liability should you fail to do so.

Complaints
If you are disappointed with your accommodation/service you should inform the manager immediately the problem occurs to give the manager the opportunity to resolve the problem. If the problem has not been resolved satisfactorily you should, within 7 days of the end of your holiday, put your comments in writing, and send by recorded delivery to your Customer Services Department, Abbeystead Projects, Forest Side Hotel, Forest Side, Grasmere, Ambleside, Cumbria LA22 9RN.
